DMCA Policy

Pump Fun respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Pump Fun will respond expeditiously to claims of copyright infringement committed using the Pump Fun service and/or the Pump Fun website (the "Site") if such claims are reported to Pump Fun's Designated Copyright Agent identified below.

This policy describes the information that should be present in a DMCA notice, the procedure for submitting such a notice, and the process for submitting a counter-notification if your content has been removed by mistake.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Pump Fun Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Pump Fun's Designated Copyright Agent.

Upon receipt of a valid DMCA Notice, Pump Fun will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.

  1. Identification of the copyrighted work claimed to have been infringed: Please provide a description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing: Please identify the specific material on the Pump Fun Site that you claim is infringing (e.g., the URL of the infringing content, or a clear description of where it is located on the Site). Provide sufficient information to allow Pump Fun to locate the material.
  3. Your contact information: Please provide your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith belief: Include the following statement: "I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law."
  5. A statement under penalty of perjury: Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Your physical or electronic signature: Provide your physical or electronic signature (e.g., by typing your full legal name).

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to Pump Fun's Designated Copyright Agent. Under the DMCA, your counter-notification must include substantially the following:

  • Identification of the material that has been removed: Identify the specific material that Pump Fun has removed or to which Pump Fun has disabled access, and the location (e.g., URL) where the material appeared before it was removed or access was disabled.
  • Your contact information: Provide your full legal name, mailing address, telephone number, and email address.
  • A statement of good faith belief: Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  • Consent to jurisdiction: Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which Pump Fun may be found, and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."
  • Your physical or electronic signature: Provide your physical or electronic signature (e.g., by typing your full legal name).

Please send your complete DMCA Counter-Notification to our Designated Copyright Agent via the contact methods provided on our Contact Us page.

Upon receipt of a valid counter-notification, Pump Fun will forward it to the party who submitted the original DMCA Notice. The original claimant will then have 10-14 business days to notify us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on Pump Fun's system. If we do not receive such notification within that timeframe, we may, in our sole discretion, restore the removed material or cease disabling access to it.
